Aboriginal Customary Law VS European Law Essay -- essays research pape
Aboriginal customary law and European law have been at odds since the first years of the European invasion, but only recently has the clash come into the open. Stuart MacMillan of the Aboriginal Resource and Development Services in the Northern Territory says that remote Aboriginal communities there and in Western Australia, South Australia and Queensland see no reason why they should submit to "whitefella law". The governments of the Northern Territory and Western Australia are investigating how indigenous law can be incorporated into state law. Chris Sidoti of the Human Rights Council of Australia says: "Some people would say that human rights runs opposite to Aboriginal law, others that it provides a universal standard to which other legal traditions must adapt. Customary law can't remain immutable. The problem for those trying to bring the two systems into line is that human rights law derives from a western legal tradition which frequently contradicts Aboriginal law. Colin McDonald, a Darwin barrister and expert in customary law, says that on such issues Australia's legal system may simply have to bite the bullet and go against the norms of international human rights. Aboriginal women have often claimed that the law has been slanted to support the rights of indigenous men over women. Lowitja O'Donoghue, who formerly chaired the government's Aboriginal affairs body ATSIC, believes that Australian law should be more aggressive in such cases. Some aspects of Aboriginal law are falling out of practice. Chris Sidoti believes that whatever balance is struck will be as distinct from traditional European law as it is from traditional Aboriginal law. "For traditional people, being put in jail is more inhuman than spearing, and any unified law would have to recognise that. Aboriginal Customary Law The High Court did, however, conclude in that case (a conclusion confirmed in WA v Commonwealth, Wororra Peoples v WA and Teddy Biljabu and others v WA, High Court, March 16 1995) that some Aboriginal land law (that which attracted the status of 'native title') survived the colonisation process. What is far less certain is the fate of Aboriginal customary laws that were not concerned with title to land. Did traditional laws on subjects such as family relationships, title to goods, community justice mechanisms, inheritance and criminal law survive c... ...e necessary, and those laws which were to be applied could not be made applicable to all of the Aboriginal peoples but only to some. It would not be inconsistent with the principle of equality before the law that, where members of the Aboriginal race have special needs, those should be recognised by special rules laid down by the law. Further, the law is flexible enough to allow the courts to consider the special situation of an Aboriginal party where that is relevant. As the courts have recognised, the sentencing of Aboriginal offenders presents particular difficulties. Judges, in an attempt to do justice in discharging the difficult role of sentencing tribal and semi-tribal Aboriginal persons, have gone further. Clearly the ordinary criminal law is capable of facing these difficulties. It is neither necessary, nor desirable, to apply to the Aboriginal peoples the rules of their customary law rather than the general law. The attempt to uphold Aboriginal customary law is one aspect of the notion that the Aboriginal peoples will benefit if they continue to be treated as a class separate from the rest of the communi ty, which must necessarily be a dependent and disadvantaged class.

Diary of a Wimpy Kid diary of a wimpy kid Greg Is going to middle school, his mom bought him a ââ¬Å"Diaryâ⬠witch has the word ââ¬Å"Diaryâ⬠right in the middle and is in big letters. He is scared to bring it to school because he does not want some 8th grader to come see him with his bookdelay and think he is a sissy cause he has a diary In 6th grade and does not want to get punched and then get made fun of. Ergs big dream and what he thinks he Is going to be like in middle school Is this guy who so popular and knows him, and hen when he gets out of school, he is going to be really famous and when they want to know what his child-hood was like he is going to give them his diary, that's why he agreed to his mom to write in his diary. Greg is espoused to write in almost all year. Greg Is not really excited because A guy named Greg has a friend named Rowley and has been friends since Greg has moved to his new house.As soon as Rowley sees that a family has moved into the hou se, that was for sail, Roller's mom went to the store and bought him a book ladled ââ¬Å"how to make friendsâ⬠and kind of felt sorry for him so I pulled my wig for him. Patty Farell, who plays Dorothy, is coming on stage, and since Greg is a tree, he thinks he can throw apples at her, but the director takes this part out of the play for health and safety. Mrs. Norton, the music director, tries to make the trees sing an embarrassing song, but on the night nobody sings out of fear and the play is ruined. Greg and Rowley's friendship is starting to fall apart.Greg invents a game where one person throws a football to make the other fall off the Big Wheel; however when Rowley falls off, he breaks his arm. Greg is jealous of the attention Rowley is getting. Rowley is also framed for scaring kindergarteners, when it was Greg wearing Rowley's hat. When Greg confesses, Greg is kicked out, and Rowley is promoted. Rowley also declares himself the owner of a comic strip, Zoo-Wee-Mama, that was created by Greg and Rowley, but Greg drops out to make his own comic strip.The two stop being friends. Greg and Rowley get into a fight at the blacktop, when the teenagers from Halloween come, and grab Greg and Rowley. They make Rowley eat the cheese, and are going to make Greg do it, too, but Greg finds a way out. The students, however, notice the cheese is gone. Greg, being a good friend to Rowley, lies and says he threw it away, but this gives Greg the Cheese Touch. Greg and Rowley becomes friends again, and Greg begins to see the good advantages of having the Cheese Touch.Even though life is kind of unfair, you will somehow get through over it, you will always succeed if it is for good but if you fail, there is reason that God did that. Causal Attribution Theories of Victim Blaming in Cases of Sexual Assault For most individuals, the thought of blaming the victim of a tragic experience for their own pain and suffering, seems preposterous. However, ascribing at least some of the blame to the victim is not uncommon (Niemi Young, 2014). Victim blaming refers to individuals finding reasons to hold the victim of an incident responsible for the crime that took place (Hayes, Lorenz Bell, 2013). For victims of sexual assault, who may already be experiencing self-blame and distrust of others, being blamed adds insult to injury (Harber, Podolski, Williams, 2015). According to Harber et. al, victim blaming can also have long-term effects on victims, such as, increased anxiety, depression, and post-traumatic stress disorder. In an effort to increase support and resources for survivors of sexual assault researchers must determine why individuals are prone to blaming the victims rather than the perpetrator of a crime. In order to answer this question of ââ¬Å"whyâ⬠we blame victims of sexual assault for their own suffering researchers use the attribution theory. This theory is used to explain how we make sense of our own and other peopleââ¬â¢s behavior. Internal attributions refer to the perception that someone is behaving in a certain way because of the ââ¬Å"typeâ⬠of person that individual is. We attribute the cause of behavior to a personââ¬â¢s personality or character rather than to the situation. My favorite TV episode : ââ¬Å"Funny Pantsâ⬠from Season 4 Episode 65b of SpongeBob SquarePants, where Squidward, Spongebobââ¬â¢s cynical neighbor and coworker,falsely informs SpongeBob that if SpongeBob laughs one more time in the next 24 hours, his laugh box will explode, and he will never laugh or giggle again. Squidwardââ¬â¢s lie attempts to stop SpongeBobââ¬â¢s incessant laughter, but SpongeBob does not stop laughing. Neither do I. SpongeBob would rather laugh and never laugh again than to live in fear, just as I would rather laugh and never laugh again than to live in fear of endometriosis. Endometriosis is a disorder in which tissue that normally lines the inside of the uterus ââ¬â the endometrium ââ¬â grows outside the uterus. Endometriosis commonly involves the ovaries, fallopian tubes and the tissue lining the pelvis. Laughing helps me grieve the person I was before endometriosis and gives peace of mind and body. If I can laugh, then I can envision and motivate myself to accomplish my goals, whether it is becoming a pediatric surgeon or receiving a publication in Teen Ink Magazine. By practicing open mindedness, I fell in love with watching Wild nââ¬â¢ Out on MTV while eating Jollof rice with chicken and I took a risk tasting banana barbeque sauce in St. Thomas. Yes, barbecue sauce made out of real bananas, and I couldnt taste the difference! With open mindedness my learning never ends and I am always guaranteed adventure. For a while, I struggled with being open minded to a friendship with endometriosis because my memories consisted of endometriosis restraining me to my bedroom floor in excruciating pain and forcing me to escape class to hide in bathroom stalls. But as I debated forming a friendship with endometriosis, endometriosis taught me the best lesson: embrace my vulnerability and my own company. When I admitted to myself that I needed help, I stopped living in fear and I reclaimed the power to steer my own life. I was liberated when I came to terms with my doctorââ¬â¢s words: ââ¬Å"The cause of endometriosis is unknown and there is no cure.â⬠I could finally enjoy spending time with myself because I realized it was me, not endometriosis, who decided to close myself off. It is me who is emotionally responsible for myself. I cannot train myself to have a specific reaction to a particular situation, but I can train myself to remember I am in control of my emotions, not the other way aro und. Ultimately, endometriosis taught me that I never lose the ability to make choices but recognizing that ability becomes harder when the choices appear limited. Endometriosis promised me that I would prouder of myself if I accepted a choice it gave me. The choice was learning how I wanted to define myself and what I wanted others to see in me. Ive accepted the choice (or challenge, as I see it), but how would I begin writing that story? Sadly, I just finished typing it.
